Professor Asher Hildebrand discusses the recent North Carolina Supreme Court decision to allow lawmakers to draw legislative maps without judicial interference on Charlotte Talks with Mike Collins. “Our constitution nationally and the NC constitution entrust the legislature with enacting laws, but it also entrusts the courts with ensuring that those laws don’t violate North Carolinians constitutional rights,” Hildebrand said. He adds that the decision to overturn a decision made only last year is “very extraordinary.” Hildebrand argues that this creates a precedent where state courts have no oversight regarding partisan redistricting. “That really does give citizens very few recourses to try and combat redistricting and to fight for a fairer system.”
