The Supreme Court has ruled that state lawmakers do not have the unchecked power to create election rules and draw congressional districts and maps, striking down the Conservative “independent state legislature theory.” This decision will keep key democratic protections in place for voters across the nation. In response to the decision, Professor Asher Hildebrand tells ABC11, “By striking down this radical idea that’s inconsistent with history and inconsistent with democracy as we know it, the Supreme Court has essentially said we’re going to keep things as they are… that legislatures set policy, but courts are also there as a safeguard in case the legislature does something that violates the constitutional rights of Americans.”
